Hi All,

finally booked the Beemer in for its MOT on Weds...GUP!!!. managed to discover that the ABS system does work... you just need to be on the road for it to finish the self check!

A question. Having just broken the law riding the bike to a non booked MOT test, am I still covered by my insurance if the bike does not have an MOT... I have looked all though my documents and can find nothing that states that I am (or not)

I know I could have booked the MOT test, but the station I normally go to is 5 mins up the road, and doesn't normally book tests however when I arrive I find its now decieded not to do bike MOTs.. so had to trudle to the other station to find they only book tests... grrrrrr

Last question. How much of any motoring offence is up to the discresion of the copper stopping you?

In my experience, as long as the bike is going to or from the MOT test station then there should not be a problem, especially if you explain to the police (if, god forbid) you get stopeed. (same for cars)

The legal side of it I am not too sure on. I think you would be hard pressed to find a policeman who would throw the book at you for it! fcrossed.gif

Provided you have an insurance certificate and a licence to drive it you'll be OK. Generally the only exclusion clause is the licence one, M.O.T and tax don't come in to it.

The legal definition is on the way to a pre booked MOT test or on the way back, so you are covered, otherwise people wouldn't be able to move their cars for a duff light or no water in the bottle, if you get my drift.
It is always at the officers discretion how you are dealt with, but there are a number of factors that will affect his decision.

The actual offence. You aren't going to get arrested for a duff light (well not usually) but you probably will for Dangerous Driving, Excess Alcohol.

You're attitude. If you blantantly deny it, or try to argue, then you will be more likely to get a ticket etc. Try imagining that you actually speak to the officer as you want to be spoken to. I grant you ther are some ignorant buggers out ther who will stick you on and be rude whatever you do/say, but i promise you they are in the minority.

What else is wrong. You were on your mobile with no seatbelt and your 4 yr old jumping around in the back (which i personally always deal very harshly with). You have no licence or insurance and four bald tyres. What do you reckon would happen.

Most stops are dealt with by way of friendly advice, which i reckon is the best way. probably the only time most people will meet a policeman (except for the cash cow cameras). We are loosing enough public confidence through cameras etc, we don't need to stick all and sundry on as well.

Unless you live in my force however wher the Traffic guys have been given a points system and have to meet a target each month, but don't get me started on that...
